Terms of Service

1. Acceptance of Terms

By downloading, installing, or using DateBack (“the Application”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Application.

2. Description of the Application

DateBack is a macOS and Windows desktop application that:

• Processes and organizes Snapchat Memories exports from a downloaded ZIP file
• Fixes file timestamps and merges media overlays locally on your device
• Organizes processed files into dated folders on your computer
• Optionally moves processed files into a cloud sync folder you provide (iCloud Drive, Google Drive, OneDrive, Dropbox, or Box)

3. License

Grant of License

DateBack is provided as a free download. You are granted a personal, non-exclusive, non-transferable license to install and use the Application on your own device for personal, non-commercial purposes. No activation key, account, or purchase is required.

Open-Source Components

DateBack includes third-party open-source components, most notably FFmpeg (GPL v2.0+). These components are governed by their own licenses, which are available in the Application and at:

Restrictions

You may not:

• Use the Application for illegal purposes
• Attempt to reverse engineer, decompile, or disassemble the Application
• Remove or modify any copyright or license notices
• Redistribute, sublicense, or resell the Application
• Use the Application to process content you do not have the legal right to process

4. User Responsibilities

Your Content

• You are solely responsible for the photos and videos you process with DateBack
• You must have the legal right to process any content you provide to the Application
• You must comply with all applicable laws regarding your content

Snapchat Content

• You must have the legal right to download and process your Snapchat Memories
• You must comply with Snapchat’s Terms of Service
• DateBack is not affiliated with or endorsed by Snapchat

Cloud Storage

When you choose a cloud destination folder in DateBack’s Cloud Mode, you are writing files into a folder managed by your cloud sync service. You are responsible for managing your own cloud storage quota and complying with your cloud provider’s terms of service.

5. Privacy

Your use of DateBack is also governed by our Privacy Policy. Key points:

• DateBack processes all media locally on your device
• We do not collect, store, or transmit your photos or personal information to our servers
• DateBack does not require or transmit a license key

6. Disclaimers

No Warranty

THE APPLICATION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OR ERROR-FREE OPERATION, OR FREEDOM FROM MALWARE OR DEFECTS. WE MAKE NO WARRANTY THAT DATEBACK WILL MEET YOUR REQUIREMENTS OR THAT RESULTS OBTAINED FROM ITS USE WILL BE ACCURATE OR RELIABLE. TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES ARE HEREBY DISCLAIMED.

Use at Your Own Risk

• You use DateBack at your own risk
• We are not responsible for any loss of data, including photos, videos, or memories — we strongly recommend keeping a backup of your original Snapchat ZIP file before processing
• We are not responsible for issues arising from third-party cloud storage services
• DateBack processes files produced by a third-party platform (Snapchat); we cannot guarantee compatibility with all export formats

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages of any kind
• We are not liable for any loss of data, loss of personal media content or memories, loss of profits, or loss of business opportunities
• Our total aggregate liability to you for all claims arising out of or related to these Terms or your use of DateBack shall not exceed the greater of (a) the amount you paid for the Application in the twelve months preceding the claim (which may be $0 as DateBack is free), or (b) $10 USD

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. If you are located in such a jurisdiction (including the EU, UK, or Australia), some of the above limitations may not apply to you, and you may have additional rights under local consumer protection law.

8. Third-Party Services

Buy Me A Coffee (Optional Donations)

• Optional donations are processed by Buy Me A Coffee outside the DateBack desktop app
• Buy Me A Coffee’s terms and privacy policy apply to donation transactions
• Donations do not unlock features; DateBack remains a free download whether or not you donate
• We are not responsible for Buy Me A Coffee’s services or policies

Snapchat

• DateBack processes Snapchat Memories exports that you have downloaded to your own device
• Snapchat’s Terms of Service apply to your use of Snapchat
• We are not affiliated with Snapchat

9. Updates and Changes

Application Updates

• We may release updates to improve functionality or fix bugs
• Updates are optional but recommended
• We are not obligated to provide updates or support

Terms Updates

• We may update these Terms at any time
• Continued use after changes constitutes acceptance
• Material changes will be noted via an updated “Last Updated” date

10. Donations and Refunds

DateBack is free to download and use. Optional donations are voluntary support for the project and do not purchase app functionality. For donation payment questions, contact Buy Me A Coffee or email support@dateback.app.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or your use of DateBack that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Connecticut. If you are located in the EU or UK, nothing in this section limits your rights under applicable local consumer protection law.
