Terms of Service for DateBack

1. Acceptance of Terms
By downloading, installing, or using DateBack ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.
2. Description of the Application
DateBack is a macOS desktop application that:
- Processes and organizes Snapchat Memories exports from a downloaded ZIP file
- Fixes file timestamps and merges media overlays locally on your Mac
- Organizes processed files into dated folders on your computer
- Optionally moves processed files into a cloud sync folder you provide (iCloud Drive, Google Drive, OneDrive, Dropbox, or Box) — syncing is handled by your cloud provider, not by DateBack
3. License
Grant of License
DateBack is proprietary commercial software. Upon purchase you are granted a personal, non-exclusive, non-transferable license to install and use one copy of the Application on your own Mac for personal, non-commercial purposes.
The license is activated by the license key you receive after purchase. Your license key is tied to your purchase and is not transferable.
Open-Source Components
DateBack includes third-party open-source components, most notably FFmpeg (GPL v2.0+). These components are governed by their own licenses, which are available in the Application under Help → Licenses and at:

- Other dependencies: see THIRD_PARTY_NOTICES.txt in the Application
The inclusion of GPL-licensed components does not make DateBack itself open-source or free software.
Restrictions
You may not:
- Use the Application for illegal purposes
- Attempt to reverse engineer, decompile, or disassemble the Application
- Remove or modify any copyright or license notices
- Redistribute, sublicense, or resell the Application or your license key
- Use the Application to process content you do not have the legal right to process
4. User Responsibilities
Your Content
- You are solely responsible for the photos and videos you process with DateBack
- You must have the legal right to process any content you provide to the Application
- You must comply with all applicable laws regarding your content
Snapchat Content
- You must have the legal right to download and process your Snapchat Memories
- You must comply with Snapchat's Terms of Service
- DateBack is not affiliated with or endorsed by Snapchat
Cloud Storage
When you choose a cloud destination folder in DateBack's Cloud Mode, you are writing files into a folder managed by your cloud sync service. You are responsible for managing your own cloud storage quota and complying with your cloud provider's terms of service.
5. Privacy
Your use of DateBack is also governed by our Privacy Policy. Key points:
- DateBack processes all media locally on your device
- We do not collect, store, or transmit your photos or personal information to our servers
- Your license key is sent to Polar.sh over HTTPS solely to verify your purchase
6. Disclaimers
No Warranty
THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
Use at Your Own Risk
- You use DateBack at your own risk
- We are not responsible for any data loss — we recommend backing up your Snapchat ZIP before processing
- We are not responsible for issues arising from third-party cloud storage services
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- We are not liable for any indirect, incidental, special, or consequential damages
- We are not liable for any loss of data, profits, or business opportunities
- Our total liability to you shall not exceed the amount you paid for the Application
8. Third-Party Services
Polar.sh (Payments and Licensing)
- Purchases are processed by Polar.sh
- Polar's Terms of Service and Privacy Policy apply to your purchase transaction
- We are not responsible for Polar's services or policies

Snapchat
- DateBack processes Snapchat Memories exports that you have downloaded to your own device

9. Updates and Changes
Application Updates
- We may release updates to improve functionality or fix bugs
- Updates are optional but recommended
- We are not obligated to provide updates or support
Terms Updates
- We may update these Terms at any time
- Continued use after changes constitutes acceptance
- Material changes will be noted via an updated "Last Updated" date
